This Terms of Use ("Terms") of Airblack Technologies Private Limited ("Company", "We", "Our", or "Us") will govern your use of the Zudo application and any associated services ("App" "Platform" or "Services"). By accessing, using, or signing up on the App or any other platform services and features in relation to the App, you ("User," "You," or "Your") are accepting the Terms set out herein, Our Privacy Policy and any additional guidelines or policies that may be posted on the App.

Please read these Terms carefully before using the App and related services. If You do not agree to any of these terms, the Privacy Policy, or any additional guidelines, please do not use the Service.

While We may attempt to notify You of major changes to these Terms, You should periodically review the most up-to-date version. The Company may, in its sole discretion, modify or revise these Terms at any time, and You agree to be bound by such modifications or revisions. Nothing in these Terms shall be deemed to confer any third-party rights or benefits.

1. SERVICE DESCRIPTION

These Terms apply to all users of the App, including contributors of content. "Content" includes text, software, scripts, graphics, photos, sounds, videos, tutorials, courses, and other materials viewable on or accessible through the Service.

The Service may include links to third-party websites, applications, or services not owned or controlled by the Company. We assume no responsibility for the content, privacy policies, or practices of third-party services. By using the Service, You expressly relieve Company from any and all liability arising from Your use of third-party services.

2. ACCOUNTS

To access certain features of the Service, You must create an Account. You may never use another person's account without permission. When creating Your account, You must provide accurate and complete information. You are solely responsible for the activity that occurs on Your account, and You must keep your account credentials secure.

You must notify the Company immediately of any breach of security or unauthorized use of Your account. Although the Company will not be liable for Your losses caused by any unauthorized use of Your account, You may be liable for the losses of the Company or others due to such unauthorized use.

3. GENERAL USE OF THE SERVICE - PERMISSIONS AND RESTRICTIONS

The Company hereby grants You permission to access and use the Service as set forth in these Terms, provided that:

3.1 Permitted Uses.

(i) You may access and use the Service for personal, non-commercial purposes; (ii) You may share content through functionality provided by the Service; (iii) You may create original content within the App's features.

3.2 Prohibited Uses.

You agree not to: (i) Distribute any part of the Service or Content without prior written authorization from the Company; (ii) Alter, modify, or reverse engineer any part of the Service; (iii) Access Content through unauthorized means or technology; and (iv) Use the Service for unauthorized commercial purposes, including selling access to the Service, placing unauthorized advertising or promotions and reselling or redistributing Service content without permission.

3.3 Commercial Use Exceptions.

Permitted commercial uses include, creating original content to promote your legitimate business or artistic enterprise and Uses expressly authorized in writing by the Company.

3.4 Technical Restrictions.

You agree not to; (i) Use automated systems, robots, spiders, or similar tools that access the Service in a manner that exceeds normal human usage; (ii) Collect personally identifiable information from the Service; (iii) Use communication systems for commercial solicitation; (iv) Circumvent security features or access restrictions; and (v) Interfere with the proper functioning of the Service.

You must comply with all applicable laws in Your use of the Service. The Company reserves the right to discontinue any aspect of the Service at any time.

4. YOUR USE OF CONTENT

4.1 Content Access and Use.

Content is provided to You AS IS for personal use as intended through the Service's functionality. You may only download Content when a download option is explicitly provided. You shall not copy, reproduce, distribute, transmit, or exploit Content without prior written consent. Some Content may be provided by third parties; the Company acts as a platform and does not claim ownership of such third-party Content.

4.2 Content Restrictions.

You understand that You may be exposed to Content from various sources and is not responsible for the accuracy or appropriateness of all Content. Content may sometimes be inaccurate, offensive, or objectionable. You waive any legal remedies against the Company regarding such Content exposure.

5. YOUR CONTENT AND CONDUCT

As a user, if You submit or post any Content including videos, images, comments, and other materials, You understand that the Company does not guarantee confidentiality of submitted Content. You are solely responsible for your Content and its consequences. You affirm, represent, and warrant that you own or have necessary rights to publish your Content.

By submitting Content, you grant the Company a worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use, reproduce, distribute, display, and perform your Content in connection with the Service and business operations.

You agree that submitted Content will not contain: (i) Third-party copyrighted material without permission; (ii) Material violating third-party proprietary rights; and (iii) Content contrary to applicable laws and regulations.

6. ACCOUNT TERMINATION POLICY

The Company will terminate user access to the Service if the User is determined to be a repeat infringer under appropriate circumstances. The Company reserves the right to terminate accounts for violations of these Terms.

7. COPYRIGHT POLICY

The Company respects intellectual property rights and expects users to do the same. If You believe Your copyrighted work was posted without authorization, submit a notification including Your contact information, Description of the infringed work.

8. WARRANTY DISCLAIMER

YOU AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from - use of or inability to use the Service, unauthorized access to Your information, Service interruptions or technical issues, Third-party content or conduct, Any other matter relating to the Service.

10. INDEMNITY

To the extent permitted by law, You agree to defend, indemnify, and hold harmless the Company from claims, damages, and expenses arising from - Your use of the Service, Your violation of these Terms and Your violation of third-party rights.

11. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

12. CHILDREN'S PRIVACY

The Services under the App are not directed towards children under 18 (eighteen). They are not allowed to register with or use the service or provide personal data. If We discover that We have collected personal information from a child under 18, we will delete that information at the earliest.

13. GOVERNING LAW AND JURISDICTION

The laws of India shall govern these Terms, regardless of Your location. You hereby expressly consent to the exclusive jurisdiction and venue located in Delhi, India, for all matters or disputes arising out of or relating to Your access or use of the App. Any cause of action arising out of or related to the Terms of Use or Your use of the App must be brought by You within one (1) month of the date such cause of action first arose, or such cause of action is forever waived by You. Each cause of action shall be adjudicated individually, and You agree not to combine Your claim with the claim of any third party.
